Civil and Commercial Litigation

 

Civil and commercial litigation involves filing and defending lawsuits brought in the courts of the State of New Mexico. Legal disputes not settled by the individuals or entities involved are submitted to a court for a judge or jury to decide. We have litigation and trial experience in all New Mexico courts, including appeals. We have represented individuals and businesses in a wide array of disputes, including those involving real estate, debt transactions, construction, breach of contract, personal injury and many others.

 

We also represent parties in alternative dispute resolution forums, such as arbitration and mediation.

 

 

Formation and Representation of Business Entities

 

We provide a wide variety of services to our business clients, from choosing the appropriate business entity for operation to dissolution. The form of business chosen for a business entity potentially affects every aspect of its operations. We assist our clients in deciding whether they want to operate as a closely held business, limited liability company, partnership, or corporation. We also provide ongoing services such as preparation and upkeep of business records and general legal advice, including contract and debtor/creditor issues, the purchase and sale of the entity or its assets and various other issues faced by small business owners.

 

 

Construction Matters

 

We offer advice and representation to businesses and individuals involved in the construction industry as owners, general contractors or sub-contractors. Services include preparation and review of construction contracts, disputes concerning adequacy of performance and mechanics lien litigation.

 

 

Contracts

 

The law of contracts pertains to many diverse areas. A contract is an agreement between two or more parties to exchange something (consideration) for something else. A contract is formed through an offer and the acceptance of the offer. A valid contract need not be in writing except in certain instances. Contractual agreements are entered into regarding many different subjects in every day life. The practice of contract law addresses assurance that a valid, binding contract is in place in the first instance, and that remedies for breach of contract are available and enforced.

 

Appellate Practice


The skills required to try a case to a jury or to a court are, in many important ways, different from those required to handle a case on appeal. The goal of trial counsel is to persuade the jury or the judge to adopt a particular view of the evidence and the facts. The objective of appellate counsel is to persuade the court to adopt a particular view of the law.   We have successfully handled numerous matters in the New Mexico appellate courts.
